Overview
Key points of the One-to-One Student Technology Laptop Program:
- All incoming full-time undergraduate degree-seeking students are eligible to receive a laptop through the One-to-One Student Technology Laptop Program. This program is mandatory for all incoming students. There is no opting out of the program.
- A portion of the technology fee charged each semester to all full-time undergraduate students covers the cost of the program.
- When a student leaves the university for any reason (including but not limited to withdrawal, leave of absence, suspension, etc.) or if the student’s status changes (including but not limited to, from full-time (registered for 12 or more credits in fall and spring semesters) to part-time, from active to not being registered for classes for a semester (skipping a semester), Leave of Absence (for a medical reason, etc.…) the student is required to return the laptop to IT Support Services (Helpdesk) prior to the student’s status change or leaving Chatham.
- Do not ‘deface’ the laptop with stickers, labels, or markings. Chatham provides a protective case for all MacBook computers. Chatham does not provide protective cases for Windows devices. Chatham does allow stickers or markings to be placed on the protective case but not the actual laptop. If a laptop is returned to IT Support Services (Helpdesk) with stickers, labels, or markings NOT completely removed (including glue residue), the student will be charged a $100.00 removal fee.
- The student (not Chatham) is responsible in the event of loss, theft, or damage of the laptop. Students assume full responsibility for the security and protection of the laptop and to maintain the laptop in good working order and repair.
- All data and applications stored on the laptop are the student’s responsibility. IT Support Services (Helpdesk) is not responsible for restoring data files or applications at the time of repair. IT Support Services highly recommends the use of Microsoft OneDrive storage for all data files.
Fall 2023 Contract
The undersigned (“Student”) hereby acknowledges, understands, and enters into the following Contract with Chatham University (“Chatham”) as a condition to possession and use of hardware and software (“Computer System,”) to be assigned to the Student during Chatham’s Hardware Distribution (“Distribution”). The Student will receive a laptop, logoed backpack, accessories, 4-year Microsoft Office365 software licensing, and 4-year manufacturer hardware maintenance to be used in the accomplishment of tasks inherent in the educational experience provided to Student by Chatham.
1. Upon signing the Chatham University One-to-One Student Technology Laptop Program Contract (“Contract”), Student will comply with all rules and regulations made by Chatham in the use of the Computer System as set forth herein as substantially established by Chatham.
2. Student will not reinstall the Computer System operating system and/or reimage the Computer System without prior notification and approval from Chatham’s Information Technology Support Services (“IT Support Services”). Student will not deface the Computer System with labels or markings of any kind. A $100 fee will be assessed to any Student for removal of labels or markings. Labels CAN be applied to the protective case provided with MacBook Computer Systems; Windows laptops do not have protective cases; no labels or markings are permitted on these Systems.
3. Chatham IT Support Services shall perform all hardware modifications or hardware upgrades made to the Computer System. Chatham must approve any and all hardware modifications and additions made to the Computer System until ownership of Computer System is transferred to Student upon graduation. All hardware modifications are to be requested through IT Support Services only.
4. Student is responsible to install and maintain the Chatham provided antivirus software. The Computer System’s operating system and antivirus software are to be kept current and up to date with all available software patches and updates.
5. Student (not Chatham) is responsible in the event of loss, theft, or damage of the Computer System. Student assumes full responsibility for the security and protection of the Computer System and to maintain the Computer System in good working order and repair, as determined by Chatham in its sole judgment reasonably exercised.
- Chatham provides four years of manufacturer hardware warranty from date of original equipment lease which may differ from Distribution or the date the Student received Computer System.
- Theft protection is NOT provided by Chatham. Student is to take full responsibility to provide theft coverage through personal insurance such as homeowners or rental coverage.
- Any loss due to theft deemed to be a mysterious disappearance/loss of Computer, is NOT covered and is the sole responsibility of the student. Student is responsible to provide full system replacement of Computer System based on lease value and/or market value at the time of theft.
- Student is required to immediately notify IT Support Services of any loss, damage or malfunction of the Computer System and shall fully cooperate with Chatham in providing accurate information as to the cause thereof. If the theft of Computer System occurred on Chatham property, the Student will immediately submit a police theft report to Chatham’s Public Safety department. If the theft occurred off Chatham property, the Student will immediately notify Chatham Public Safety as well as immediately submit a police theft report with the local authorities where the theft occurred.
- Computer System accidental damage claims are limited to one (1) repair claim per academic year. Additional claims in the same academic year must be approved by Chatham’s IT Support Services. All accidental repair claims include a $100 deductible fee charged to Student. Any and all payments made by Student personal insurance in compensation for the loss, theft or damage of the Computer System is hereby assigned to Chatham. Student shall pay to Chatham a $100 deductible fee for any claim placed on Computer System in the US and a $200 deductible for any claim placed outside the US. Deductible fee payment is due at the outcome of the claim and will be applied to the Student’s Chatham account.
6. Chatham makes no warranties in respect to the Computer System, whether expressed, implied, and including any warranty of merchantability, fitness for use or particular purpose. The only warranties that are applicable to the Computer System, are those provided by Computer manufacturer.
7. Student shall be solely responsible for ensuring that all files and programs stored or processed on the Computer System are legally obtained and licensed in accordance with the manufacturer. Student shall further be responsible for the use of the system and software to assure conformity with applicable licensing, laws and regulations.
8. Student shall be solely responsible for all data stored on the Computer System. This includes, but is not limited to, the backup of all data including application data, photos, music, and student downloaded applications and utilities. IT Support Services, at the time of repair, is not responsible for data backup or restore. IT Support Services is limited to the responsibility of providing the original image for the Computer System which is to include the Computer System operating system and applications provided at Distribution.
9. Student hereby agrees that they will not sell, contract to sell, lease, encumber, lien, or dispose of the Computer System so long as this contract is in effect. Unless ownership of the Computer System is transferred to the Student under paragraph 10 below, the Computer System shall at all times be and remain the property of Chatham.
10. Student has completed their undergraduate degree and has made payment of all tuition, technology fees, and any other charges due to Chatham, Chatham will assign ownership of the Computer System and applicable software licensing to Student, and this contract will terminate. Upon transfer of ownership, all software licensed by Chatham must be uninstalled and removed. Student is responsible for removal and/or cost.
- Due to Microsoft licensing restrictions, access to and downloads of Microsoft Office 365 will terminate upon Student graduation. This includes all Microsoft Office 365 applications including OneDrive.
11. In the event Student ceases to be a full-time and matriculated student at Chatham for any reason including, but not limited to, Leave of Absence, Withdrawal, or status change from full-time to part-time, Student shall within ten (10) days of the termination of their status as a full-time student, return the entire Computer System received at time of distribution to IT Support Services in clean, good working order. After the Computer System is verified by an IT Support Services staff member and the Return Form is signed by both parties, this contract will terminate. If Student fails to return the entire Computer System, in clean, good working order to Chatham within ten (10) days from the date of status change, Student will be considered in default of this Contract. Student shall still be required
to return the entire Computer System, will be subject to a $100.00 processing fee and the Student’s account will be forwarded to legal collection for recovery of any and all damages suffered by Chatham. The Student’s breech of this Contract, including, but not limited to, the entire cost of a new replacement system may be collected. In the event of legal collection, the Student shall also pay all costs incurred in the collection of his or her account together with all and any fees incurred by Chatham.
12. In the event Student chooses to purchase any available upgrade option(s) for the Computer System which are installed within the Computer System, and this Contract is terminated, Student purchased upgrades will be uninstalled by a professional IT Support Services staff member and returned to the Student within ten (10) days from the date the Computer System was received and receipted by IT Support Services.
13. Student and Chatham agree that the laws of the Commonwealth of Pennsylvania shall control this Contract and that venue and jurisdiction for the interpretation and enforcement of this Contract is exclusively vested in the Allegheny County Pennsylvania Court of Common Pleas or that courts minor judiciary system.
14. Chatham, by its delivery of the Computer System to Student, agrees to be bound by this Contract.
15. Student, by signing this Contract, agrees to be bound by this contract.
16. In the event of default of any of the terms and conditions of this contract by Student, Chatham shall, in addition to all other legal or equitable rights given to it by law, have the immediate right, without hearing, to seize the Computer System, to make all necessary repairs to the Computer System to place it in good working order (if reasonable to do so in the sole judgment of Chatham) and to sell the same (if reasonably possible) to any third party at any price which can be obtained. Student shall pay to Chatham immediately upon demand, the costs associated with the seizure of the Computer System and any repairs made to it, together with the remaining balance of the Computer System lease amount or the difference between the remaining lease amount and the sales price (if any) of the Computer System to the third party (or, if no sale can be reasonably made, the entire remaining lease amount) together with all costs and attorney’s fees incurred in the seizure, sale of the Computer System and the collection of the sums due herein.
